Proving That Your Condition Was Aggravated by a Work Accident
People with pre-existing conditions have a much harder time proving that they are entitled to workers' compensation. Usually, injured workers simply need to show that they have an injury that was caused by the accident at work. When a pre-existing injury is involved, workers must also prove that their injury was made worse by the accident.
Our law office has secured workers' compensation for many employees with pre-existing conditions. We use experienced medical experts to help build our clients' cases. Then, we assertively fight for our clients' interests in negotiations and during workers' compensation hearings.
Workers' Compensation Second Injury Fund in Louisiana
You may be able to recover workers' compensation for your entire injury if your pre-existing condition was aggravated by a workplace accident. However, the state may reimburse your employer for some of the costs paid to you. Louisiana's second injury fund (SIF) reimburses part of a workers' compensation claim to an employer when an employee had a permanent pre-existing condition before being injured on the job.
In order to recover this compensation, your employer must have known about your pre-existing condition and your secondary injury must have been caused by, or made worse by, your pre-existing condition. The second injury fund was put in place to prevent discrimination against workers with disabilities.
